1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) constitute a binding legal agreement between you and The Remnant Bible Academy (“RBA,” “the Academy,” “we,” “us,” or “our”) governing your access to and use of our website, online learning platform, and affiliated digital community, the Berean Fellowship Community (collectively, the “Services”).
By accessing or using the Services in any capacity — as a visitor, prospective student, enrolled student, instructor, moderator, ministry partner, or otherwise — you agree to be bound by these Terms. If you do not agree to these Terms in full, you must not access or use the Services.
These Terms should be read together with our Privacy Policy, our Statement of Faith, and any applicable enrollment agreements, course-specific policies, or community guidelines published on the Services, all of which are incorporated herein by reference. In the event of a direct conflict between these Terms and a course-specific policy, the course-specific policy shall govern solely as to the subject matter it addresses.
2. Age Requirement: Minimum Age of 18
Access to and use of the Services is restricted to individuals who are eighteen (18) years of age or older. The Services are not directed to, designed for, or intended to be used by individuals under the age of 18, and no such individual is permitted to create an account, enroll in a course, or otherwise use the Services.
By accessing or using the Services, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into these Terms. If we become aware that an account has been created or used by an individual under the age of 18, we reserve the right to immediately suspend or terminate that account and delete associated information, consistent with our Privacy Policy.
3. Nature and Purpose of The Remnant Bible Academy
RBA is a Christian educational ministry devoted to rigorous, doctrinally sound, academically grounded Bible instruction. RBA is a ministry endeavor, not a degree-granting accredited institution of higher education unless and until expressly stated otherwise in writing. Any certificates, diplomas, or completion records issued by RBA reflect completion of RBA’s internal curriculum and are not equivalent to, and should not be represented as, a degree conferred by an accredited college, university, or seminary.
All instruction offered through RBA is provided from a distinctly Christian, Scripturally grounded theological perspective, consistent with RBA’s Statement of Faith and doctrinal distinctives. RBA does not hold itself out as theologically neutral, and course content will reflect RBA’s doctrinal convictions.
4. Accounts and Enrollment
4.1 Account Registration
To access certain features of the Services, including course content and the Berean Fellowship Community, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify RBA immediately of any unauthorized use of your account.
4.2 Enrollment
Enrollment in RBA courses is subject to acceptance by RBA and may be conditioned upon completion of an application, intake form, or statement of agreement with RBA’s Statement of Faith. RBA reserves the right, in its sole discretion, to accept, decline, defer, or revoke enrollment for any applicant or student, including for reasons related to doctrinal incompatibility, conduct, or capacity.
5. Statement of Faith and Doctrinal Agreement
As a condition of enrollment and participation in the Berean Fellowship Community, students agree to engage with course content, discussion, and community life in a manner consistent with RBA’s Statement of Faith and doctrinal distinctives. RBA welcomes multi-denominational fellowship and sincere theological inquiry; however, RBA reserves the right to moderate, restrict, or remove content or participation that directly contradicts, undermines, or is used to actively proselytize against RBA’s core doctrinal convictions within RBA’s own community spaces.
Nothing in these Terms is intended to compel belief; rather, this section governs conduct and participation within RBA’s Services, which RBA maintains as a space for instruction consistent with its own stated doctrinal identity.
6. Course Fees, Payments, and Ministry Partnership Contributions
6.1 Course Fees
Certain RBA courses may require payment of a fee, as disclosed at the time of enrollment. All fees are stated in U.S. Dollars unless otherwise noted. Payment is processed through a third-party payment processor, as described in our Privacy Policy. You agree to provide accurate and current payment information.
6.2 Refund Policy
Unless otherwise expressly stated in a course-specific policy at the time of enrollment, course fees are non-refundable once a student has accessed course content. RBA may, in its sole discretion, grant exceptions to this policy on a case-by-case basis. Any applicable refund terms for a specific course will be disclosed to you prior to enrollment.
The Ministerial Ordination Program is subject to its own, more specific No Refund Policy, which governs refund terms for that program in full.
6.3 Ministry Partnership Contributions
Financial contributions made as a Ministry Partner are voluntary donations in support of RBA’s ministry mission and are not payment for goods or services. Such contributions are generally non-refundable. Donors should consult their own tax advisor regarding the deductibility of any contribution, as RBA’s tax-exempt status, if applicable, will be disclosed separately.
7. The Berean Fellowship Community and Standards of Conduct
The Berean Fellowship Community is a Student Only space intended for edifying, doctrinally grounded fellowship, discussion, and mutual encouragement among RBA students. By participating in the Community, you agree to the following standards of conduct. You agree not to:
- Post, transmit, or promote content that is doctrinally deceptive, deliberately divisive, or intended to provoke discord contrary to the spirit of Christian fellowship.
- Harass, abuse, threaten, defame, or demean any other User, instructor, moderator, or member of RBA’s Leadership Team.
- Solicit other Users for commercial purposes, unrelated ministry promotion, or personal financial gain, except as expressly permitted by RBA’s community guidelines.
- Post content that is unlawful, obscene, sexually explicit, or that infringes upon the intellectual property or privacy rights of any third party.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload viruses, malicious code, or attempt to gain unauthorized access to the Services or the accounts of other Users.
- Use automated means (bots, scrapers, or similar tools) to access or extract data from the Services without RBA’s express written consent.
RBA-designated Moderators are authorized to enforce these standards within their assigned Community spaces, subject to oversight by RBA’s Administrator. RBA reserves the right to remove any content and to suspend or terminate any account, at its sole discretion, for violation of these standards.
8. Intellectual Property Rights
8.1 RBA Content
All course materials, curriculum, lectures, recordings, written content, graphics, logos, and other materials made available through the Services (“RBA Content”) are the property of RBA or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. RBA grants you a limited, non-exclusive, non-transferable, revocable license to access and use RBA Content solely for your personal, non-commercial educational use as an enrolled student.
You may not reproduce, distribute, publicly display, publicly perform, sell, license, or create derivative works from RBA Content, in whole or in part, without RBA’s prior express written consent. This restriction includes, without limitation, recording, downloading, screen-capturing, or redistributing course lectures or materials outside of the Services.
8.2 User Content
You retain ownership of any content you submit to the Services, including community posts, comments, and profile information (“User Content”). By submitting User Content, you grant RBA a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute such User Content solely in connection with operating and promoting the Services. You represent that you own or have the necessary rights to any User Content you submit, and that such content does not infringe the rights of any third party.
9. Scripture, Citations, and Third-Party Materials
Course content may reference or quote Scripture from various translations, as well as theological works, scholarly commentary, and other third-party materials, used in accordance with applicable fair use principles or appropriate licensing. Such references remain the property of their respective copyright holders. RBA does not claim ownership over Scripture texts or third-party scholarly works referenced in its curriculum.
10. Disclaimers
THE SERVICES AND ALL RBA CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RBA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS FREE FROM INACCURACY.
RBA COURSE CONTENT REFLECTS THE THEOLOGICAL CONVICTIONS AND SCHOLARLY JUDGMENT OF RBA AND ITS INSTRUCTORS. WHILE RBA IS COMMITTED TO DOCTRINAL RIGOR AND ACADEMIC INTEGRITY, RBA DOES NOT WARRANT THAT ANY PARTICULAR THEOLOGICAL POSITION TAUGHT WILL BE FREE FROM GOOD-FAITH SCHOLARLY DISAGREEMENT, AND STUDENTS ARE ENCOURAGED TO STUDY SCRIPTURE DILIGENTLY FOR THEMSELVES, IN THE MANNER OF THE BEREANS OF ACTS 17:11.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RBA, ITS FOUNDER, LEADERSHIP TEAM, INSTRUCTORS, MODERATORS, AND AFFILIATED MINISTRIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF RBA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL RBA’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES EXCEED THE TOTAL AMOUNT OF FEES YOU HAVE PAID TO RBA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless RBA, its Founder, Leadership Team, instructors, moderators, and affiliated ministries from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of a third party.
13. Suspension and Termination
RBA reserves the right, in its sole discretion and without prior notice, to suspend or terminate your account and access to the Services for any violation of these Terms, RBA’s community standards, or for conduct that RBA determines, in good faith, to be harmful to RBA, its Users, or its ministry mission. You may also terminate your account at any time by contacting RBA using the information provided in Section 17.
Upon termination, your right to access the Services will immediately cease. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and indemnification — shall survive.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles. Prior to initiating any formal legal proceeding, the parties agree to first seek to resolve any dispute arising out of or relating to these Terms or the Services through good-faith, direct communication, and, where appropriate, biblically-grounded mediation consistent with RBA’s ministry values, before resorting to litigation.
Any legal action not resolved through the process described above shall be brought exclusively in a court of competent jurisdiction located within the State of Georgia, and you consent to the personal jurisdiction of such courts.
15. Changes to These Terms
RBA may update these Terms from time to time to reflect changes in our practices, the Services, or applicable law. When we make material changes, we will update the “Last Updated” date at the top of these Terms and, where appropriate, provide additional notice. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms.
16. General Provisions
- Entire Agreement — These Terms, together with our Privacy Policy and any incorporated policies, constitute the entire agreement between you and RBA regarding the Services.
- Severability — If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
- No Waiver — RBA’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment — You may not assign or transfer these Terms without RBA’s prior written consent. RBA may assign these Terms in connection with a reorganization of its ministry operations.
- No Legal or Professional Advice — Nothing in the Services constitutes legal, financial, medical, or professional counseling advice; course content is educational and ministry-oriented in nature.
